These General Sales Conditions (hereinafter, “Terms & Conditions“) intend to regulate the online sales of the products available on the website https://roccatoscanaformaggi.com (hereinafter, the “Website“) and its payment and delivery.
The seller of the products and owner of the website is: Rocca Toscana Formaggi s.r.l., located in Via Giacomo Puccini n.79 – 52100 Arezzo (Ar), VAT Registration number IT02232120515.
The user who intends to purchase (hereinafter “Customer“) is required, before sending the order, to carefully read these Terms & Conditions. All contracts will be made under the Italian law and subject to the Italian jurisdiction (Legislative Decree No. 70/2003 and subsequent amendments).
The characteristics and the price of the various products for sale on the Website (hereinafter “Product” or “Products“) are shown on the page related to each Product.
The contract stipulated between Rocca Toscana Formaggi s.r.l. and the Customer is intended as concluded with the approvement of the order by Rocca Toscana Formaggi s.r.l .. The order approvement will be confirmed to the Customer through an email with order details. The Customer must check the confirmation email and, should he find any error in the order he will have a maximum of 12 hours since receiving the confirmation email to contact our Customer Service at (+39) 0575 1696205 or by email at firstname.lastname@example.org. After this deadline, the order will be processed for shipment and changes will no longer be accepted. In any case, the contract will be executed upon successful payment.
These Terms and Conditions may be subject to changes and their date of publication on the Website equals to the date of entry into force.
Upon receipt of the order, Rocca Toscana Formaggi s.r.l. reserves the right to verify the actual availability of the products ordered. In the event of one or more missing products, our Customer Service will clearly indicate it in the Order Confirmation and the Customer, within the following 12 hours, will alternatively have the right to reply by confirming the shipment of only the available Products or cancelling the order. Rocca Toscana Formaggi s.r.l. will not charge you for that. In case of no replying within 12 hours, the order will be considered confirmed only for the available Products which will then be processed for shipment. The equivalent of the undeliverable Products, since they are not available, will, in any case, be refunded from the payment made by the Customer, who will then be required to pay only the balance of the confirmed Products.
The information, characteristics and prices of each Product are available, with its Product codes, on the website.
The visual representation of the Products on the Website, where available, normally corresponds to the photographic image accompanying the descriptive sheet. It is understood that any image of the Products has the sole purpose of presenting them for sale and may not be perfectly representative of its characteristics and quality but may differ in color and size. In the event of a difference between the image and the written Product sheet, the description of the Product sheet always prevails.
The images of the Products included on the Website do not constitute a contractual element, as they are to be considered merely representative.

Transport and delivery
Rocca Toscana Formaggi s.r.l. delivers the Products exclusively to Italy and to the following European countries:
The Customer accepts the faculty of Rocca Toscana Formaggi s.r.l. to change the prices of the Products (as well as the shipping costs) at any time; without prejudice to the Customer, the prices and costs indicated on the Website will be applied at the time the order is created and therefore at the time the order is sent, as indicated in the Order Confirmation email.
Rocca Toscana Formaggi s.r.l. will proceed with the delivery through specialized carriers. At the time of delivery, the presence of the Customer is required; if at the time of delivery the Customer is absent, he may delegate a third party, as long as he is of age, according to the applicable law based on the place of delivery.
At the time of Delivery, the Customer is obliged to check that the packaging is intact, that the Products received correspond to what stated in the order and in the transport document. In the event of visible defects, such as incorrect quantities and/or incorrect Products and/or non-integrity of the packaging, the Customer is required both to report such anomalies on the transport document and to contact the Customer Service without any delay. If the Customer intends to report anomalies, he is still required to sign the transport document indicating “subject to control over the integrity of the products”; if this does not happen, the Customer cannot subsequently dispute the external non-conformity of the Product and its quantity with respect to what you ordered.
Rocca Toscana Formaggi s.r.l., except in cases of force majeure or unforeseeable circumstances, will deliver the ordered Products within 7 (seven) working days since the day following the Order Confirmation. The Products will be delivered to the address indicated by the Customer during the purchase procedure in the appropriate “Shipping Data” field.
However, Rocca Toscana Formaggi s.r.l. is never responsible for unforeseeable delays or those not attributable to it.
Once the Products have been shipped, the Customer will receive a shipping confirmation email which will include a link to refer to for tracking the shipment.
Packaging and storage of products
The products of Rocca Toscana Formaggi s.r.l. must be kept in a cool, dry place, they require refrigeration at controlled temperature only after being opened. Our deliveries – not refrigerated – are expected with fast delivery times.
In order to avoid product deterioration during shipments in periods of hot weather, online purchases are suspended from May 15 through September 15. In this period, purchases and shipments can still be agreed with refrigerated by contacting Customer Service at (+39) 0575 1696205 or at the email address firstname.lastname@example.org.
Order documentation and billing
Rocca Toscana Formaggi s.r.l. will issue a duly numbered tax receipt at the time of shipment and deliver it together with the goods, both for private individuals and companies. In order to issue the receipt, only the information provided by the Customer will be considered and it is therefore necessary that the Customer pays the utmost attention in entering them and in their subsequent verification.
If the purchase is made as a professional operator, the Customer must request an invoice, indicating all the data necessary for billing. Rocca Toscana Formaggi s.r.l. will issue an invoice for the order and deliver a copy together with the goods.
Products are subject to the laws and regulations in force regarding customs and export control and therefore must be purchased, exported and used in compliance with these regulatory provisions, which the Customer, while submitting the order, declares to know.
Exclusion of the right of withdrawal
This contract relates to the supply of goods which, by their nature, cannot be returned or are liable to deteriorate or alter rapidly. The Customer cannot exercise the right of withdrawal provided for in articles 64 and following of the consumer code. Confirmation of the purchase order constitutes express acceptance of this agreement.
Any reimbursement to the Buyer will be made exclusively by issuing a purchase voucher with a value equal to the total of the products to be refunded and which can be spent in a future order exclusively for the purchase of products and in a single solution.
In case of lack of conformity of the Products sold by Rocca Toscana Formaggi s.r.l. the Client must immediately contact our Customer Service at (+39) 0575 1696205 or by email to email@example.com.
Errors and limitations of liability
he information relating to the Products provided through the Website is constantly updated. However, it is not possible to guarantee the total absence of mistakes of which Rocca Toscana Formaggi s.r.l. cannot be considered responsible, except in the case of willful misconduct or gross negligence. Rocca Toscana Formaggi s.r.l. reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to modify or update the information at any time without prior notice, without prejudice to the rights of the Customer pursuant to these Terms and Conditions and to the Consumer Code.
Rocca Toscana Formaggi s.r.l. assumes no responsibility for inefficiencies attributable to force majeure, if it fails to process the order within the time stipulated in the contract, and/or in any case due to facts and fault not attributable to it.
Rocca Toscana Formaggi s.r.l. cannot be held responsible to the Customer, except in the case of willful misconduct or gross negligence, for inefficiencies or malfunctions connected to the use of the internet outside of its own control or that of its sub-suppliers.
